Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale govern the relationship between The Artist SRL (hereinafter referred to as the "Organizer") and any person making a booking or purchasing a service (hereinafter referred to as the "Customer").

These Terms and Conditions apply to:

• Creative workshops
• Private events
• Children's birthday parties
• Team-building events
• Gift vouchers

Any booking or purchase implies full acceptance of these Terms and Conditions of Sale.

2. Bookings

Bookings may be made online, by phone, or on-site.

• A booking is confirmed only upon full payment and receipt of a confirmation email.

• The Organizer reserves the right to refuse a booking in the event of non-payment, incomplete information, or inappropriate behavior.

3. Pricing and Payment

All prices are stated in euros (€), including VAT.

• Accepted payment methods:

  • Credit or debit card

  • Bank transfer

  • Mobile wallet

  • Wero

  • Cash (on-site only)

• For online or telephone bookings, payment must be completed no later than 24 hours before the activity.

• Failing this, the booking will be automatically cancelled.

4. Cancellations and Refunds

Cancellation by the Customer

• More than 48 hours before the activity: 100% refund
• Less than 48 hours before the activity: 50% refund

Any cancellation request must be submitted by email.

5. Participation and Safety

Participants must comply with all safety instructions provided by the Organizer.

• Access may be refused to any person who is intoxicated or whose behavior is considered dangerous or inappropriate.

• Children must be accompanied by a responsible adult.

• The accompanying adult is responsible for the supervision and conduct of the minor.

• Any damage caused intentionally will be charged to the responsible participant.

• No equipment, materials, or supplies may be removed from the premises without payment or prior authorization.

6. Clothing and Personal Belongings

The activities involve the use of paint, which may cause stains.

• Protective equipment and clothing are provided; however, their use remains the responsibility of the Customer.

• The Customer acknowledges and accepts the risk of stains or paint marks.

• The Organizer shall not be held liable for any damage to clothing, footwear, personal belongings, or other items resulting from participation in the activities.

7. Liability

The Organizer takes all reasonable measures to ensure the safety of participants.

However, the Organizer shall not be held liable for:

• Failure by participants to comply with safety instructions
• Loss or theft of personal belongings
• Indirect, incidental, or consequential damages

The Organizer's liability shall be limited to the amount paid by the Customer for the activity, except in cases of gross negligence or willful misconduct.

The activities are covered by professional public liability insurance.

8. Personal Insurance

Each participant is encouraged to have appropriate personal insurance coverage.

9. Late Arrival

Un retard de plus de 15 minutes peut entraîner le refus d’accès sans remboursement afin de ne pas perturber le groupe.

10. Image Rights

Photographs and videos may be taken during activities and used for communication, promotional, and marketing purposes.

Any participant who does not wish their image to be used must inform the Organizer prior to the start of the activity.

11. Acceptance of the Rules

The Customer making the booking agrees to inform all participants of these Terms and Conditions of Sale.

All participants shall be deemed to have read and accepted these Terms and Conditions.

Failure to comply with the rules may result in exclusion from the activity without refund.

12. Intellectual Property

All content, visuals, logos, and text are protected by intellectual property laws.

Any use, reproduction, distribution, modification, or exploitation without prior written authorization is strictly prohibited.

13. Storage and Collection of Artwork

Artwork created during the workshops is stored temporarily by the Organizer to allow for drying and collection by participants.

Unless otherwise agreed, artwork must be collected by the Customer within a maximum period of one (1) month following the date of the workshop.

After this period, the Organizer can no longer guarantee the storage or availability of the artwork.

Once this period has elapsed, the artwork may be removed from the storage area to ensure the proper operation of the workshops. The Organizer therefore reserves the right to dispose of the artwork at its sole discretion, including through recycling, donation, or destruction, without any compensation being due.

It is the Customer's responsibility to ensure that their artwork is collected within the specified timeframe.

14. Governing Law

These Terms and Conditions of Sale are governed by the laws of Belgium.

Any dispute arising in connection with these Terms and Conditions shall fall within the jurisdiction of the courts of the judicial district where the Organizer's registered office is located.
